Questions received:


1.1	Section 1: Instructions to the Tenderers in article 3 PARTICIPATION section 3.3.

As You said in this section that we can deliver copies of documents whether these documents must be notary approved?



2.1	In B.1.1. Sewage of Donji Velemerić GP01, Item Pump station, Specification is exactly the same as Pumping Station in B. 1.2 of Varoš. As it looks as “copy paste” mistake we are kindly asking for explanation


2.2	Specification for Waste Water Plant 50 PE Varoš is missing in the Bill of Quantities


3.	In attachment, we deliver you a list of questions about documentation used to for the tender :


3.1	.&amp;nbsp; Volume 1, section 4, form 4.3. Power of attorney

If  d.d. has a person that is authorised by law to represent the company, which is stated in the excerpt from the court register, do we have to fill the form 4.3. Power of attorney?


3.2	 Volume 1, section 1:Instruction to tenderers, Tender preparation, 12 Information/documents to be supplied by the tenderer, article 12.1.5.

All the documentation required in the article 12.1.5. (Form4.1., Form4.2., Form4.3.) has already been given in the article 12.1.2. Do we have to repeat the same documentation again?


3.3	Volume 1, section 1:Instruction to tenderers, Tender preparation, 12 Information/documents to be supplied by the tenderer, article 12.1.11.

Unless otherwise provided in the contract, all goods purchased under the contract must originate in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme specified in clause 3.1 above. For these purposes, &#8220;origin&#8221; means the place where the goods are mined, grown, produced or manufactured and/or from which services are provided. The origin of the goods must be determined according to the EU Customs Code or to the relevant international agreement applicable. 

Volume 1, section 1:Instruction to tenderers, General parts, 3 participation. article 3.1 Participation in tendering is open to all legal persons participating either individually or in a grouping (consortium) or tenderers which are established in one of the Member States of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the IPA programme under which the contract is financed.&amp;nbsp; Participation is also open to international organisations. Participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed. 

Can all the goods necessary for the construction of sewage system and waste water treatment of Barilovic Municipality be acquired in Croatia? 

3.4	 Volume 1, section 1:Instruction to tenderers, Tender preparation, 12 Information/documents to be supplied by the tenderer, article 12.1.4

What documentation about cashflow statements is necessary?

3.5	Volume 4.3.2&#45;bill of quantities 

Do items number 129 and 130 (Installation of metal door and metal window) imply only installation or supply and installation? The similar situation was noticed in items: 136, 420, 421, 427&#8230;

3.6	Volume 4.3.2&#45;bill of quantities 

Purification device UZP2  is indicated on the disposition of sewage, pump station and purification plant (M 1:5000) but it is missing from the bill of quantities. Does this mean that the purification device UZP2 is not a subject of this tender? Please elaborate.

3.7	Volume 4.3.2&#45;bill of quantities 

All quantities in items of pump stations in Donji Velemeric (item 325&#45;334) and Varos (item 360&#45;370) are identical. Is this a coincidence? Please elaborate.

3.8	Volume 4.3.2&#45;bill of quantities 

Item 005 &#8220;Assurance of exicting installation&#8221;. In case of potential displacement of exicting installations (water, HT, HEP etc.), do we have to anticipate this costs and include them in item 005? Please elaborate.

3.9	There is no specific time period in which we have to complete the construction works of sewage system and waste water treatment of Barilovic Municipality. Does this period depend solely on our dynamic plan of the construction works?

3.10	Can Manager of electro&#45;installation works and Manager of mechanical installation works be engaged as subcontractors?&amp;nbsp; 

Answers:


1.1	Copies of documents used in tender procedure must be approved by public notary.


2.1 This is not copy/paste error. The specification is the same.

2.2 Specification for Waste Water Plant 50 PE Varoš is missing in the Bill of Quantities. The new updated version of Bill of Quantities contains device description in new item no 371. This new updated version of Bill of Quantities will be delivered to all respective Tenderers.


3.1.&amp;nbsp; Yes, you need to fill the form 4.3. Power of attorney.

3.2   No. Each required document need to be provided only once in Tender.

3.3.&amp;nbsp; All the goods necessary for the construction of sewage system and waste water treatment of Barilovic Municipality can be acquired in Croatia if they meet criteria set for EU rules of origin which are defined in A2b Eligibility programmes 2007&#45;2013 in line with (EC) No 1085/2006.

3.4. Required « Cashflow statements » are reffered to “Balance (Croatian translation: Bilanca) and Benefit/Loss Balance (Croatian translation: Račun dobiti i Gubitka). Submitted documents must be in line with provisions of Volume 1, Section 4, Form 4.4 Financial statements. 

3.5 All items in Bill of Quantity imply supply AND installation.

3.6  Specification for UZP 2 &#45; Waste Water Plant 50 PE Varoš is missing in the Bill of Quantities. The new updated version of Bill of Quantities contains device description in new item no 371. This new updated version of Bill of Quantities will be delivered to all respective Tenderers.

3.7 Item description is the same in both cases.

3.8 No. This item covers only the cost for locating and assuring of the existing installations.

3.9 The first sentence is not correct. Period of implementation of the task is defined in Special Conditions : Volume 2, Section 3, Article 34, and in Procurement notice.

3.10  Manager of electro&#45;installation works and Manager of mechanical installation works can’t be engaged as subcontractors. Subcontracting is allowed only based on written agreement with Contracting Authority and prior approval of Contracting Authority. In document Instruction to the Tenderers provisions 12.1.9. and 12.2 and in document Procurement notice provision 16 all requirements that Tenderer need to fullfill are defined. Based on that the Tenderer need to demonstrate that he has key experts on his disposal.&amp;nbsp;

		Stupanjem na snagu Zakona o postupanju s nezakonito izgrađenim građevinama (NN 90/11) određeni su uvjeti i postupak legalizacije nezakonito izgrađenih građevina. Općina Barilović objavljuje Javni poziv za podnošenje zahtjeva za izdavanje rješenja o izvedenom stanju za nezakonito izgrađene ili rekonstruirane građevine koji je u nastavku.&#8221;

Na temelju članka 28. stavka 2. Zakona o postupanju s nezakonito izgrađenim zgradama (NN broj 90/11) Općina Barilović objavljuje

JAVNI POZIV

za podnošenje zahtjeva za izdavanje rješenja o izvedenom stanju

za nezakonito izgrađene ili rekonstruirane građevine


Stupanjem na snagu Zakona o postupanju s nezakonito izgrađenim građevinama (NN 90/11 ) određeni su uvjeti i postupak legalizacije nezakonito izgrađenih građevina.

Nezakonito izgrađenom građevinom smatra se nova zgrada ili rekonstruirani dio postojeće zgrade izgrađen bez odgovarajućeg akta kojim je odobrena gradnja ili protivno tom aktu.

Predmetno se odnosi na nezakonito izvedenu gradnju evidentiranu do 21. lipnja 2011. godine na način propisan Zakonom, ako su do toga dana izvedeni:

&#45;svi građevinski i drugi radovi te ako se koristi ili se može koristiti ili,

&#45;svi grubi konstruktivni građevinski radovi (temelji, zidovi, odnosno stupovi s gredama i stropovi) sa ili bez krovišta i ako su u pogledu namjene, veličine i smještaja na čestici izgrađeni u skladu s prostornim planom koji je važio na dan  stupanja na snagu ovog Zakona.

Ozakonjenje se odnosi i na nezakonito izgrađenu zgradu koja je u pogledu namjene, veličine i smještaja na čestici nije izgrađena u skladu sa Planom pod uvjetom i u postupku propisanom ovim Zakonom.

Nezakonito izgrađena zgrada legalizira se donošenjem rješenja o izvedenom stanju. Zahtjev za izdavanje rješenja o izvedenom stanju podnosi se:

Zahtjevi se mogu predati neposredno u pisarnici na navedenoj adresi ili preporučeno poštom.

Zahtjevu se prilaže: 

&#45;geodetski elaborat za evidentiranje podataka o zgradama ovjeren od nadležnog katastarskog ureda, izrađen od ovlaštenog geodeta, 

&#45;tri primjerka arhitektonske snimke koju je izradio ovlašteni arhitekt, 

&#45;dokaze o ispunjenom bitnom zahtjevu mehaničke otpornosti i stabilnosti izrađenima po ovlaštenom inženjeru građevinarstva, 

&#45;uvjerenje Policijske uprave o mjestu prijavljenog prebivališta do 21. lipnja 2011. godine za nezakonito izgrađene zgrade iz čl. 5. st. 1. podstavak 1. i čl. 17. st. 4. Zakona 

&#45;dokaze u svrhu obračuna naknade za zadržavanje nezakonite izgrađene zgrade u prostoru (izvod iz zemljišne knjige ili drugi odgovarajući dokaz da ima pravo graditi – sudsko rješenje, ugovor, suglasnost suvlasnika, dokaze o vremenu građenja) 

Rok za podnošenje zahtjeva je do 31. prosinca 2012. godine 

Rješenje o izvedenom stanju ne može se donijeti dok nije plaćen komunalni i vodni doprinos, odnosno dok nije plaćena naknada za zadržavanje nezakonito izgrađenog objekta.

CONTRACT SPECIFICATIONS

6.	Description of the contract

Overall development of Barilovic Municipality rural area and environmental protection of river Korana will be achieved through the construction of the sewage system and waste water treatment. Construction of sewage pipelines and waste water treatment plants will take place in settlements Barilovic and Donji Velemeric. Booth systems consider separate drainage method. In Barilovic 1.593 m of sewage pipelines in one gravity flow zone will be constructed. Purification of sewage will take place in new waste water treatment plant for 357 PE. In Donji Velemeric 4.170 m of sewage pipelines in two gravity flow zones (2.782m + 1.308m) will be constructed. Due to terrain configuration, two pump stations are necessarily for correct function of the system. Purification of sewage will take place in two new waste water treatment plants – one for 50 PE and other for 200 PE.For waste water treatment, biological treatment procedures will be used. Waste water treatment plants (357 PE and 200 PE) in Barilovic and Donji Velemeric use activated sludge technology and a small treatment plant of Donji Velemeric /Varos with 50 PE uses “Biofilm” technology.

TERMS OF PARTICIPATION

8.	Eligibility and rules of origin

Participation is open to all legal persons participating either individually or in a grouping (consortium) of tenderers which are established in a  Member State of the European Union or in a country or territory  of the regions covered and/or authorised by the  specific instruments applicable to the programme under which the contract is financed (see also heading 22 below). All works, supplies and services under this contract must originate in one or more of these countries. Participation is also open to international organisations. The participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.

9.	Grounds for exclusion

Tenderers must submit a signed declaration, included in the Tender Form for a Works Contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contract procedures for EU external actions.


10.	Number of tenders

Tenderers may submit only one tender per lot. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.

11.	Tender guarantee

Tenderers must provide a tender guarantee of 16.754,97 euros when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties.

12.	Performance guarantee

The successful tenderer will be asked to provide a performance guarantee of 10% of the amount of the contract at the signing of the contract. This guarantee must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.

13.	Information meeting and/or site visit

The tenderer is strongly advised, but not obliged to attend the clarification meeting and to visit and inspect the site of the works and its surroundings for the purpose of assessing, at his own responsibility, expense and risk, factors necessary for the preparation of his tender and the signing of the contract for the works. 

The clarification meeting and site visit will be held in Barilovic on September 1, 2011 at 10:00 AM and 11:00AM local time.


14.	Tender validity

Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

15.	Period of implementation of tasks

Nine (9) months 

 


SELECTION AND AWARD CRITERIA

16.	Selection criteria

The minimum qualifying criteria for the sole tenderer include:

a)	Tenderer must be a registered firm or natural person legally capable of carrying out the specified works.

b)	The average annual turnover of the tenderer in the last 3 years (2008, 2009 and 2010) must be equal to or exceeding 2.000.000,00 EUR and at least 586.423,80 EUR  in each year.&amp;nbsp; 

c)	Tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of: 837.748,29 EUR 

d)	Tenderer must have approval for the performance of construction in accordance with Act on architectural and engineering services and activities in physical planning and building – OG 152/08 Group “G”) 

e)	Tenderer must carry out at least 70% of the contract works by his ownresources (equipment, materials, human and financial resources)

f)	Tenderers key personnel: 

Key staff	Job description	education level	years of experience on the same or similar jobs

g)	All key personnel to be mobilised for this project must have appropriate experience and proven qualifications relevant to works of a similar nature to this project as it is specified in the Tender Dossier, volume 1, section 1. Instruction to tenderers, sub&#45;clause 12.1.9.

h)	Tenderer, as a main works contractor, must have successfully completed 2 projects of the same nature and complexity comparable to the works concerned by the tender over the last five (5) years.


The Joint venture/ consortium as whole (all members together) and the lead member must satisfy following minimum qualifying criteria:

a)	The average annual turnover of the Leader of consortium/Joint venture  in the last 3 years (2008, 2009 and 2010) must be equal to or exceeding 600.000,00 EUR, but not less than 209.437,07 EUR  in each year. 

b)	Tenderer must be a registered firm or natural person legally capable of carrying out the specified works.

c)	The average annual turnover of the consortium/joint venture in the last 3 years (2008,2009 and 2010) must be equal to or exceeding 2.000,000,00 EUR and at least 586.423,80 EUR in each year.&amp;nbsp;   

d)	Tenderer must have access to sufficient credit and other financial facilities to cover the required cash flow for the duration of the contract. In any case, the amount of credit available must exceed the equivalent of: 837.748,29 EUR 

e)	Tenderer must have approval for the performance of construction in accordance with Act on architectural and engineering services and activities in physical planning and building ((OG 152/08)  Group “G”

f)	Tenderer must carry out at least 70% of the contract works by his own resources (equipment, materials, human and financial resources) 

g)	Lead member of joint venture/consortium has ability to carry out at least 50% of the contract works by his own means. 

h)	Another member of joint venture/consortium must have ability to carry out at least 10% of the contract works by his own means

i)	 Tenderer, as a main works contractor, must have successfully completed 2 projects of the same nature and complexity comparable to the works concerned by the tender over the last five (5) years. 

j)	All key personnel to be mobilised for this project must have appropriate experience and proven qualifications relevant to works of a similar nature to this project as it is specified in the Tender Dossier, volume 1, section 1. Instruction to tenderers, sub&#45;clause 12.1.9.

18.	How to obtain the tender dossier

The tender dossier is available from Opcina Barilovic, Barilovic bb 47252 Barilovic upon payment of 200 euros on account no. 2340009&#45;1800700000 of Privredna Banka Zagreb, branch office Karlovac, Domobranska 6, which excludes courier delivery. It is also available for inspection at the premises of the Contracting Authority, address as in point 5 above. Tenders must be submitted using the standard tender form included in the tender dossier, whose format and instructions must be strictly observed.

Tenderers with questions regarding this tender should send them in writing to opcina.brilovic@ka.t&#45;com.hr Opcina Barilovic, Barilovic bb, 47252 Barilovic (mentioning the publication reference shown in item 1) at least 21 days before the deadline for submission of tenders given in item 19. The Contracting Authority must reply to all tenderers&#8217; questions at least 11 days before the deadline for submission of tenders. Eventual clarifications or minor changes to the tender dossier will be published at the latest 11 days before the submission deadline on the EuropeAid website at https://webgate.ec.europa.eu/europeaid/online&#45;services/index.cfm?do=publi.welcome. and on the web page of the Paying Agency for Agriculture, Fisheries and Rural Development www.apprrr.hr.

	Općina  Barilović smije sklapati ugovore o javnoj nabavi sa gospodarskim subjektima bez ikakovog ograničenja jer Načelnik Općine Barilović gospodin Dražen Peraković nije član upravnog ili nadzornog tijela, ne obavlja upravljačke poslove u niti jednom gospodarskom subjektu te nije vlasnik udjela,  dionica, odnosno drugih prava na temelju kojih sudjeluje u upravljanju, odnosno u kapitalu bilo kojeg gospodarskog subjekta s više od 20%..

      <description>Hrvati plaćama pokrivaju svega oko 80 posto troškova &#45; Savez samostalnih sindikata Hrvatske, koji mjesečno računa sindikalnu košaricu za četveročlanu radničku obitelj i koja sadrži minimalne mjesečne izdatke za prehranu, stanovanje, prijevoz, higijenu, odijevanje, obrazovanje i kulturu, izvijestio je kako košarica za veljaču iznosi 6.399,84 kune.


Sindikalna se košarica po svojemu iznosu razlikuje od regije do regije pa je tako u veljači najskuplja u Zagrebu i Zagrebačkoj županiji, dok je najjeftinija u Slavoniji i Baranji. Košarica za veljaču iznosi 6.399,84 kune, a košarica za obitelj u podstanarstvu iznosi 7.961,42 kune. Ako obitelj posjeduje osobni automobil, tada minimalni mjesečni izdaci za prijevoz i održavanje automobila iznose 802,72 kune.


Prosječnom isplaćenom neto plaćom može se pokriti samo 82,45 posto troškova života


Prema izračunu SSH, minimalni troškovi života u Republici Hrvatskoj u veljači su iznosili 6.399,84 kune.


U prosječnoj potrošnji najveći udio ima prehrana koja čini 36,44 posto ukupnih troškova. Stanovanje čini 28,53 posto, odijevanje 9,60 posto, obrazovanje i kultura 11,77 posto, prijevoz 8,89 posto, a higijena 4,76 posto ukupnih troškova.


Prosječna isplaćena neto plaća u Republici Hrvatskoj u prosincu 2008., prema podacima Financijske agencije, povišena je u odnosu na studeni 2008. za 214,00 kuna i iznosila je 5.277,00 kuna. Prosječnom isplaćenom neto plaćom može se pokriti samo 82,45 posto troškova života.


Podstanarska obitelj može pokriti samo 66,28 posto troškova života


Minimalni troškovi života obitelji koja je podstanar u veljači su iznosili 7.961,42 kune.


U prosječnoj potrošnji najveći udio ima stanovanje koje čini 42,55 posto ukupnih troškova. Prehrana čini 29,30 posto, obrazovanje i kultura 9,46 posto, odijevanje 7,72 posto, prijevoz 7,14 posto, a higijena 3,83 posto ukupnih troškova.


Podstanarska obitelj tako prosječnom isplaćenom neto plaćom iz prosinca može pokriti samo 66,28 posto troškova života.&amp;nbsp; (index.hr)</description>

      <title>Zbog nestajanja pčela štete u Hrvatskoj veće od 100 milijuna eura</title>

      <description>U posljendnjih godinu dana pčelari SAD&#45;a i Europe prijavljuju velike gubitke pčelinjih zajednica. Tijekom zime 2006./2007. gubici u SAD&#45;u su iznosili oko 34 posto, a u Republici Hrvatskoj tijekom zime 2007./2008. oko 27 posto. Najnoviji podaci iz Hrvatskog pčelarskog saveza (HPS) govore o 80.000 izgubljenih pčelinjih zajednica, a neposredna šteta za pčelare u RH iznosi oko 10 milijuna eura. Posredna šteta od gubitka pčelinjih zajednica, kao glavnih oprašivača poljoprivrednih kultura, u Hrvatskoj je mnogo veća i iznosi oko 100 milijuna eura.


Posljedice nestanka pčela postaju očite


&#8220;Valja istaknuti da pčele oprašuju preko 70 posto usjeva kojima se čovječanstvo prehranjuje. Stoga bi nestanak pčela na određenoj lokaciji uzrokovao ubrzani nestanak preko 20.000 biljnih vrsta što bi se negativno odrazilo na cjelokupnu ekološku ravnotežu. Bilo bi stoga nerazborito promatrati pčele samo kao ekonomske životinje, već ih moramo promatrati kao ekološke životinje važne za cijelu biocenozu&#8221;, ističu u HPS&#45;u.


&#8220;U Republici Hrvatskoj pčele su nezaobilazni oprašivači uljarica (uljene repice i suncokreta) te mnogih voćnih i ratarskih nasada. Neosporno je utvrđeno da je u Hrvatskoj veoma teško naći pčele koje samostalno, bez pomoći pčelara, žive u prirodnim staništima. Djelomice je uzrok tome suvremena poljoprivredna proizvodnja, zatim  nedostatak valjanih mjera u okviru agrarne politike, te ponajviše bolesti pčela.&amp;nbsp; Razumljivo da su se u potragu o uzrocima uginuća uključili mnogi pčelari, mediji i  znanstvenici&#8221;, dodaju.


Tako se Hrvatski pčelarski savez uključio u projekt COLOSS (FA 0803) koji okuplja 106 znanstvenika iz Europe, Kine, Kanade, Egipta i SAD&#45;a podijeljenih u četiri radne skupine &#45; dijagnostika i monitoring pčelinjih bolesti, nametnici i patogeni u pčelarstvu, okoliš i pčelarstvo te bioraznolikost i vitalnost pčelinjih zajednica. Glavni cilj radne skupine je međusobna razmjena informacija, koordinacije za uspostavu standardiziranog monitoringa, utvrđivanje manjih i većih čimbenika uginuća pčela te razvoj održivih alata za pčelare i veterinare kako bi se uklonili štetni učinci po pčelarstvo i bioraznolikost.


Čitav projekt COLOSS (FA 0803) službeno je počeo u studenom 2008. godine, a završava se u lipnju 2012. godine. Hrvatski predstavnici u Upravnom odboru COLOSS&#45;a su dr. Tomljanović i prof. Kezić. Do sada su održane tri konferencije COLOSS&#45;a: u ožujku 2007. u Wageningenu (Nizozemska), početkom travnja 2008.g u Ateni i početkom rujna 2008. u Belfastu. Sljedeća konferencija će se održati  3. i 4. ožujka 2009. u organizaciji Hrvatskog pčelarskog saveza i Agronomskog fakulteta Sveučilišta u Zagrebu u prostorijama Agronomskog fakulteta u Zagrebu. Očekuje se dolazak preko 70 uglednih znanstvenika iz Europe i svijeta koji će pokušati pronaći odgovore na mnoga neobjašnjiva uginuća pčelinjih zajednica. (index.hr)</description>

      <title>Antikorupcijska kampanja Vlade RH</title>

      <description>U svom nastojanju na unaprjeđivanju suzbijanja korupcije u 2008. godini Hrvatski Sabor donio je dokument koji definira okvir antikorupcijskog djelovanja &#45; Strategiju suzbijanja korupcije, a Vlada RH, na temelju tog okvira, izradila je i usvojila provedbeni Akcijski plan

2009. godina donosi nam intenziviranje borbe protiv korupcije na svim frontovima pri čemu će jedno od značajnih sredstava biti i antikorupcijska kampanja.


Vlada namjerava provesti antikorupcijsku kampanju, kojom će se putem medija i neposrednim kontaktom s građanima utjecati na širenje svijesti o štetnosti korupcije unutar svih dobnih skupina, afirmirati pristup „nulte tolerancije“ na korupciju, upoznati građane s politikom suzbijanja korupcije kao i ohrabriti građane na prijavljivanje korupcije.


Ministarstvo pravosuđa je izradilo koncept antikorupcijske kampanje te je zaduženo za njeno provođenje.


Kampanja je edukativno&#45;promidžbenog karaktera, a sastoji se od promidžbe na televiziji, radiju, Internetu, postavljanja oglasnih plakata, kreiranja internetske stranice, antikorupcijske „hip&#45;hop platforme“ u formi glazbeno&#45;scenskog djela namijenjene mlađoj generaciji te „Antikorupcijskog sajma“.
